Rental Agreement
Event Reservation
A signed proposal outlining rental items, location, date/time, payment agreement and cancellation fees will serve as the basis for the reservation. Fees may be assessed for irreparable damage or theft of any rental materials . A card is required to be kept on file until after rental materials are returned and inspected for proper future use.
Client Responsibilities

Safe Handling: The Client agrees to handle all rented decor items with care and in a safe manner. This includes preventing misuse, damage or potential hazards.

Venue Access: The Client will ensure that the event venue provides necessary access and setup time for Twilight Escapes to deliver, set up, and retrieve decor items as agreed upon in the proposal. Any delays or limitations must be communicated in advance.

Supervision: The Client is responsible for supervising the decor items during the event, ensuring they are not subject to theft, vandalism, or unauthorized alterations.

Weather Protection: In the case of outdoor events, the Client will take measures to protect decor items from adverse weather conditions, such as wind, rain, or extreme temperatures.

Restrictions, Permits and Venue Compliance: The Client will obtain any required permits or approvals for specific decor elements. It is the Client’s responsibility to ensure that balloons and related decor comply with safety regulations and venue rules. Twilight Escapes is not liable for any consequences resulting from non-compliance with such requirements.
Company Responsibilities

Timely Delivery and Setup: Twilight Escapes will deliver and set up the decor items at the specified location and time as outlined in the signed proposal. Our team will work diligently to create the desired ambiance and ensure a seamless setup process.

Rental Item Inspection: Before and after the event, Twilight Escapes will conduct thorough inspections of all decor items to identify any pre-existing damages and verify their condition. Any discrepancies will be documented and discussed with the client.

Professionalism: Our team will conduct themselves professionally and courteously throughout the decor setup and event. We will be available for communication and coordination to address any questions or concerns
Creative Control
The Client acknowledges that Twilight Escapes retains creative control over these designs to maintain consistency with the company's quality and brand standards. Any specific requests for creative changes or client-provided design elements should be communicated and agreed upon in writing during the planning stages to ensure the seamless incorporation of the client's vision into the overall decor concept.
Media Usage
The Client grants Twilight Escapes permission to capture photographs and/or videos of the balloon decor items and their setup during the event. These photos may be used for promotional and marketing purposes, both online and in print. The Client acknowledges that no compensation will be provided for the use of photographs for promotional purposes.
Damage Beyond Repair/Theft of Rental Items
The renter acknowledges that they are responsible for all equipment from the time of possession to the time of return. Renter assumes the entire risk of loss, regardless of cause. If items are lost, stolen, or damaged the renter will assume the cost of replacing or repair, not to exceed $400. Damage includes, but is not limited to, tears, rips, scratches, dents, missing pieces, missing parts, missing instructions, permanent stains, cuts, gouges, burns, permanent aesthetic changes, holes, stickers, decals, confetti or glitter, any condition that hinders functionality, or any damage beyond normal wear and tear to be determined in the sole discretion of Twilight Escapes.
Rental Unavailable due to Damage or Theft
Every attempt will be made to repair or replace an item prior to a reserved event, should it be stolen or completely destroyed by the previous renter. However, should an item be unavailable to rent due to damage or theft, an available alternate item will be offered or a refund will be given for the item that is unable to be rented.
Adhere to Safety Precautions

Handling Helium-Filled Balloons: When handling helium-filled balloons, exercise caution to prevent inhaling helium, which can be harmful. Keep balloons secured to prevent accidental releases that could harm the environment or cause safety concerns.

Choking Hazards: Balloons can pose choking hazards, especially for young children. Ensure that balloons are kept out of reach of small children and that any unused or deflated balloons are properly disposed of to prevent accidental ingestion.

Flame and Heath Source: Do not allow balloons to come into contact with open flames, candles, or heat sources, as they can pop and create fire hazards.

Secure Placement: Balloon and decor items should be securely anchored to prevent tipping or falling. It is essential to ensure that decor elements, such as arches, backdrops, or hanging objects, are stable and cannot pose a risk to attendees. When using balloon decor outdoors, consider potential weather hazards. Balloons may deflate or become a safety concern in high winds, rain, or extreme temperatures. It is essential to have a plan for securing or removing outdoor balloon decor in adverse weather conditions.
Limit of Liability
Twilight Escapes and all representatives are only financially responsible and liable for up to but not to exceed the payments and security deposit received by the client. The Client agrees to indemnify and hold harmless Twilight Escapes and their agents, employees, and affiliates from and against any and all claims, losses, liabilities, expenses, damages, or including legal fees arising out of the use of balloons, rented decor items or related services provided. This indemnification extends to any claims by third parties and covers any acts or omissions related to the services or the Client's actions. This provision shall survive the termination or expiration of this Agreement.
